Terms of Service

1. Customer acknowledges that (s)he has care, custody and control of the Josh Something totes while the totes are at the Customer’s location. Customer accepts responsibility for all loss or damage to the totes. If the totes are damaged or lost while in the Customer’s possession the customer will be obligated to pay the full retail value of the totes. Retail value of the totes is $25 for each damaged tote.

2. Customer acknowledges that (s)he has care, custody and control of the Josh Something furniture pads while the furniture pads are at the Customer’s location. Customer accepts responsibility for all loss or damage to the Wheels. If the furniture pads are damaged or lost while in the Customer’s possession the customer will be obligated to pay the full retail value of the furniture pads. Retail value of the furniture pads is $15.00 each.

3. Customer acknowledges that (s)he has care, customer and control of the Josh Something Hand Trucks while the Hand Trucks are at the Customer’s location. Customer accepts responsibility for all loss or damage to the Hand Trucks. If the Hand Trucks are damaged or lost while in the Customer’s possession the customer will be obligated to pay the full retail value of the Hand Trucks. Retail value of the Hand Trucks is $75.00.

4. Customer acknowledges that (s)he has sole responsibility to schedule and be present at appointments for drop-off and pick-up of the Josh Something totes. If the customer does not give 48 hours notice to reschedule appointments there may be additional delivery or cancellation fees applied in the amount of $50.00.

5. Customer acknowledges that (s)he has sole responsibility to have the Josh Something totes, Josh Something furniture pads and Josh Something Hand Trucks returned by the agreed upon date. For each additional day that the Josh Something Boxes are not returned there will be an additional rental charge of $1.50 per day per tote. If the totes are not returned after 30 days and there has been no communication to extend the rental, it is assumed that the customer wishes to purchase the totes; and will be charged the full retail value of the totes at a rate of $25/tote. For each additional day that the furniture pads are not returned there will be an additional rental charge of $1.00 per day. If the furniture pads are not returned after 30 days and there has been no communication to extend the rental, it is assumed that the customer wishes to purchase the furniture pads; and will be charged the full retail value of the furniture pads at a rate of $15.00/ each pad. For each additional day that the Hand Trucks are not returned there will be an additional rental charge of $1.50 per day. If the Hand Trucks are not returned after 30 days and there has been no communication to extend the rental, it is assumed that the customer wishes to purchase the Hand Truck; and will be charged the full retail value of the Hand Truck at a rate of $75.00 each.

6. Customer acknowledges that their credit card will be kept on file for the duration of the rental agreement. Customer acknowledges and authorizes Josh Something to charge any amount associated with the above stated terms and conditions.

7. Customer grants Josh Something the right to enter the property at the said address for the delivery and the pick-up address to deliver and pick-up equipment at the specified time. Customer shall only release the equipment to a Josh Something employee.

8. Customer  agrees to keep the equipment in his/her custody and not to sublease, rent, or sell the equipment. Equipment will remain in the possession of the Renter but are the property of Josh Something.

9. In the event that there is no one available to accept the delivery at the agreed upon time, there will be a $30.00 fee to re-deliver the order.

10. Indemnification. I agree to indemnify and hold you, your officers, agents, and employees harmless from and against all liabilities, claims, actions, proceedings, damages, losses, cost and expense, including attorneys fees, for all injuries or death of any person or damage to any property occurring or arising from or connected with directly or indirectly, my possession, use and return of any of the product(s). The Customer shall be in charge of the product(s) operation, and is fully responsible for its operation as well as the return of the product(s) in good working orders. Josh Something and its officers, employees and agents are not responsible for injury occurring to the Customer or to any other persons using the product(s), and the Customer further agrees to hold Josh Something and its officers, employees and agents harmless against any injury or property claims. The Customer shall indemnify Josh Something and its officers, employees and agents from/against any cost incurred due to claims from anyone and for attorney’s fees and related costs involving the use and return of the product(s), should any legal action become necessary.

11. Josh Something warrants that the product(s) rented under this Rental Agreement will be in good working order on the effective date of the Rental Agreement. Product(s) supplied and maintained subject to this warranty. Josh Something’s obligation under this Rental Agreement is limited to repairs or replacement of the product(s) when the Customer determines that it does not conform to this warranty.

12. Josh Something reserves the right to add, change or modify this Rental Agreement at anytime without formal notice. All previously signed agreements prior to any changes will be honored as written and agreed upon with confirmed signature.
